PROMOTION TERMS AND CONDITIONS

Book an eligible cruise through Cruise.com for two or more people sharing a balcony or higher category stateroom during the applicable period set forth below by calling 888-333-3116 and receive a certificate for a five-night stay at a participating Mexico resort for the same number of people booked on the cruise on a room-only basis (the “Promotion”).
These terms and conditions (“Terms and Conditions”) set forth a legally binding agreement among Cruise.com, the purchaser (“Purchaser,” “you” or “your”) who purchases products and/or services through Cruise.com, and Open Network Exchange Inc (“ONE”, and together with Cruise.com, “we”, “us”, “our”), the fulfilment provider for the resort stay certificate. Please review these Terms and Conditions thoroughly as well as all terms and conditions and policies and procedures supplied by the provider of any product or service (“Provider”) offered through the Promotion (“Provider Terms”). To the extent of a conflict between these Terms and Conditions and Provider Terms, these Terms and Conditions will govern and control. By purchasing and/or redeeming products and/or services through the Promotion, you acknowledge and agree to be bound by these Terms and Conditions, the Cruise.com Privacy Policy, and Provider Terms, and you accept these Terms and Conditions on the behalf of any traveling companions, users of any product or service purchased through the Promotion, and/or guests (including minors and those under any disability) (collectively with you, “Guests”). Additionally, you agree that it is your sole responsibility to inform all Guests of the contents of these Terms and Conditions and all applicable Provider Terms.
In some instances, these Terms and Conditions and separate guidelines, rules, or terms of service setting forth additional or different terms and/or conditions (collectively, “Additional Terms”), will apply to your participation in the Promotion. For example, in addition to these Terms and Conditions, any contest, sweepstakes or other promotion we offer as part of the Promotion or to Promotion purchasers, will also be subject to separate official rules and terms, which will be posted in the promotion materials during the applicable promotion period and which will govern the Guest’s participation, and our execution, of each such promotion. To the extent there is a conflict between these Terms and Conditions and any Additional Terms, these Terms and Conditions will control unless the Additional Terms expressly state otherwise.
The Promotion is for a limited time. The Promotion is not redeemable for cash, is non-transferrable and is valid on new bookings only. All upgrades are based on availability and current fees at the time of booking. The Promotion is only available to legal residents of the United States or Canada who are 21 years of age or older. The Promotion is only available for new bookings on select cruise lines and/or cruise itineraries, and on a limited availability and capacity-controlled basis (regardless of stateroom availability). Other exclusions may apply; void where prohibited. Changes or refunds may not be permitted. Please carefully review all Provider Terms and restrictions when purchasing a cruise or reserving a resort stay pursuant to the Promotion. The Promotion or any part of it may be changed or ended at any time.
Five-Night Resort Vacation When You Book a Balcony or Higher Category Stateroom on Any Cruise Line (September 1, 2024 – September 4, 2024)
To qualify for a certificate for a five-night stay at a participating Mexico resort, you must book a cruise between September 1, 2024 and September 4, 2024 by calling Cruise.com at 888-333-3116 and that cruise must be for two or more people sharing a single stateroom (balcony or higher) that sails between September 1, 2024 and December 31, 2024. If you qualify for the Promotion, you will receive a code to activate your account and receive a certificate for a five-night stay at a resort in Mexico for the same number of people booked on the cruise on a room-only basis.
Cruise
Your cruise purchase covers the cruise fare, taxes and fees, and includes all regular onboard meals and entertainment. Your cruise purchase does not include gratuities, alcoholic beverages, shore excursions, speciality restaurants, baggage fees, travel protection/insurance, upgrades, additional guests, travel expenses (airlines, ground transfers), onboard expenditures, and any other expenses not specified as being included. The cruise is subject to the cruise line’s Provider Terms and passage/cruise contract.
Guests (if Purchaser chooses to add a Guest to the booking) must meet all eligibility requirements, including age restrictions, to sail as described on the cruise line’s website and Provider Terms as of the date of departure unless the Guest is the child of the Purchaser (in which case such minor guest(s) must be accompanied at all times during the cruise by the Purchaser). Guests must have all necessary identification and/or cruise documents (including but not limited to a valid passport, visa (if applicable) and all other necessary travel documents, which include any health certifications/proofs of vaccination that are required by the cruise line and/or applicable governments/ports) required for the cruise. As set forth in more detail in the applicable cruise line passage/cruise contract, the cruise line reserves the right to refuse to embark any Guest, at any time if, in the sole opinion of the cruise line, a Guest is unfit for any reason for the cruise. We shall not be responsible for any cancellations, delays, diversions or substitution or any acts or omissions whatsoever by cruise operators or any other persons providing any cruise-related services or accommodations. Purchaser and any Guests are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that we have not and will not obtain or provide travel insurance or any other form of insurance on the Guests’ behalf.
Resort Certificate
To redeem the Promotion certificate, you will receive a code that will direct you to register and set up an account at hotelsbycruise.com where you can redeem the certificate for an eligible resort stay in Mexico. By registering an account and using hotelsbycruise.com you agree to the website terms of use and privacy notice. Please carefully review these before participating in the Promotion.
The Promotion certificate covers the cost of the resort room on a room-only basis for the base rate (unless noted otherwise) and does not cover the resort fee or any local taxes or charges, upgrades, travel, transfers, travel insurance or other related costs for which you are liable. Extra nights’ accommodation, all-inclusive fees, room upgrades, board upgrades, additional guests, special facilities or any other such supplements are chargeable and are to be paid by you, at the time of the booking or upon check-in based on the resort’s Provider Terms. Any Guest under 21 years of age must be accompanied by a Guest 21 years of age or older who shall assume responsibility for their care during the stay. Certain resorts may have additional age restrictions, such as requiring guests to be at least 30 years old. Please review the individual resort Provider Terms. We reserve the right to cancel any booking that does not comply with a resort’s booking requirements. Stays are subject to availability and must be made at least seven days prior to check-in.
The Promotion certificate is subject to an expiration date. The code to activate the certificate must be redeemed by December 31, 2024. Once active you will have nine months to book an eligible resort stay and that stay must occur 12 months of the certificate activation date. Unused certificates are non-refundable. Each resort’s Provider Terms apply to any booking made at such property and you are responsible for compliance with such Provider Terms. If you cancel your booking for any reason, you will not be refunded or provided with a replacement certificate.
AVAILABILITY; MODIFICATIONS TO PRICES OR BILING TERMS
All products and services are capacity controlled and subject to availability. Such products and services are not guaranteed until confirmation is received from the Provider. Availability may be limited during key periods throughout the year such as (but not limited to), Valentine’s Day, Mother’s/Father’s Day, school holidays, public holidays and the month of December.
Products and services included in the Promotion may not be available at all times and may be substituted or discontinued at any time. We reserve the right, at any time, to change prices and billing methods for products and services sold, effective immediately upon posting on the products and services or by e-mail delivery to you. Providers retain certain rights to increase fares and rates (including, without limitation, taxes, service charges, airport charges, and government fees), modify itineraries, change availability, and change and/or discontinue promotions and/or special offers, at any time for any reason. Any increase in price or rate imposed by the Provider will be passed on to Purchaser, and Purchaser agrees to such increase, unless otherwise stated in the Provider Terms related to the individual transaction.
NO RESPONSIBILITY TO SELL MISPRICED PRODUCTS OR SERVICES
We do our best to describe every item, product or service offered through the Promotion as accurately as possible; however, we do not warrant that specifications or pricing displayed is complete, accurate, reliable, current, or error-free. In the event of any errors relating to the pricing or specifications of any item, product or service, we shall have the right to refuse or cancel any orders in our sole discretion. If we charged your credit card or other account prior to cancellation, we will issue a credit to your account in the amount of the charge.
BOOKING CANCELLATION/CHANGES
The fees assessed by a Provider as a result of a cancellation or change are set forth on the Booking Confirmation and apply to all transactions purchased through us. Each Provider has specific cancellation policies and fees separate and apart from our cancellation policies and fees. Provider Terms may treat name changes and departure date changes as cancellations.
If transportation or other services are cancelled by the Provider, all sums paid to the Provider for services not performed in accordance with the contract between the Provider and you will be refunded within 30 days of receiving the funds from the Provider with whom the services were arranged, or if the funds were not sent to the Provider, the funds shall be returned within 14 days after cancellation by the Provider to you unless you request the Provider to apply the money to another travel product and/or date.
Seller of Travel
ONE is registered with the State of Florida as a Seller of Travel. Registration No. #ST-43055. ONE is also a registered seller of travel in the following states: Washington UBI #604-664-678, Hawaii #TAR-7441 and California #CST 2147520-50. Registration as a seller of travel does not constitute approval by the State of California. ONE is not a participant in the California Travel Restitution Fund. California requires certain sellers of travel to have a trust account or bond. ONE maintains a Consumer Protection Bond issued by Philadelphia Indemnity Insurance Company in the amount of $100,000.00.
